Thank you for contacting me about H.R. 2339, the Protecting American Lungs and Reversing the Youth Tobacco Epidemic Act of 2020. I appreciate hearing your views on this issue, and I apologize for the delay in my response.

      As you know, the legislation, which is sponsored by Representative Frank Pallone, Jr. (D-NJ) would ban flavored tobacco products and impose taxes and sales restrictions on e-cigarettes. H.R. 2339 was approved by the House of Representatives on February 28, 2020 by a vote of 213-195. I opposed this bill because its implementation would create counterproductive efforts to restrict access to products that may provide a less harmful alternative to millions of adults who smoke traditional cigarettes. This includes the bill’s prohibition of menthol e-liquids, which available evidence indicates are used relatively rarely by youth. Although I strongly support efforts to reduce smoking especially among our nation's youth, I was very concerned about the bill's prohibition on menthols, which would disproportionately impact African Americans. Nine-in-ten African-Americans smoke menthol cigarettes which makes it likely that the Food and Drug Administration could use its authority under the legislation to ban menthol to target members of the black community.
